Article 1 – Definitions
In these Terms & Conditions:
• Entrepreneur: the natural or legal person who offers products or services to consumers via distance contracts (Giselle Designs).
• Consumer: the natural person who does not act for purposes related to a trade, business, craft, or profession and who enters into a distance contract with the Entrepreneur.
• Distance Contract: a contract concluded between the Entrepreneur and the Consumer within the framework of an organized system for the distance sale of products.
• Right of Withdrawal: the option for the Consumer to withdraw from the distance contract within the cooling-off period.

Article 3 – Applicability
1. These Terms & Conditions apply to every offer made by the Entrepreneur and to every distance contract concluded between Entrepreneur and Consumer.
2. Before the distance contract is concluded, the text of these Terms will be made available to the Consumer.
Article 4 – The Offer
1. If an offer has a limited validity or is subject to conditions, this will be explicitly stated.
2. The offer contains a complete and accurate description of the products offered. Handmade items may differ slightly from the product photos.
Article 5 – The Agreement
1. The contract is concluded at the moment the Consumer accepts the offer and meets the terms set out.
2. The Entrepreneur will confirm the receipt of the order electronically.
Article 6 – Right of Withdrawal
1. The Consumer has the right to withdraw from the purchase of standard (non-personalized) products within 14 days after receiving the goods, without giving any reason.
2. The withdrawal period starts the day after the Consumer receives the product.
Article 7 – Costs in Case of Withdrawal
1. If the Consumer exercises the right of withdrawal, return costs are at the Consumer’s expense.
2. The Entrepreneur will refund the purchase price (including original shipping costs if applicable) within 14 days after receiving the returned goods.
Article 8 – Exclusion of the Right of Withdrawal
1. The following items cannot be returned:
• Personalized or custom-made products.
• Earrings (for hygiene reasons).
2. Products that cannot be returned will be clearly indicated in the offer.
Article 9 – The Price
1. Prices stated in the webshop include VAT (if applicable).
2. Shipping costs are stated separately before the Consumer completes the order.
Article 10 – Conformity and Warranty
1. The Entrepreneur guarantees that the products comply with the contract, the specifications mentioned, and reasonable quality requirements.
2. In the case of faults or defects, the Consumer must notify the Entrepreneur within 7 days of delivery.
Article 11 – Delivery and Execution
1. The Entrepreneur will take the greatest possible care when receiving orders and executing deliveries.
2. The place of delivery is the address provided by the Consumer. The Consumer is responsible for providing the correct shipping address.
3. Delivery times are indicative. The Entrepreneur is not liable for delays caused by shipping companies.
Article 12 – Continuing Transactions: Duration, Termination, and Renewal
1. If a contract has been concluded for the continuous or periodic supply of products, it may be terminated by the Consumer at any time with due observance of the agreed termination rules and a notice period of one month.
2. Renewal of such agreements will be done only with explicit consent from the Consumer.
Article 13 – Payment
1. Payments must be made in advance via the available payment methods in the webshop.
2. The Consumer has the duty to report inaccuracies in payment details immediately.
Article 14 – Complaints Procedure
1. Complaints about the execution of the contract must be submitted to the Entrepreneur within 7 days after the Consumer has discovered the defects.
2. The Entrepreneur will respond to complaints within 14 days of receipt.
Article 15 – Disputes
1. Dutch law applies to these Terms & Conditions.
2. Disputes will be submitted to the competent court in the Netherlands.
Article 16 – Additional or Deviating Provisions
Additional provisions or provisions deviating from these Terms may not be to the detriment of the Consumer and must be recorded in writing or in such a way that they can be stored by the Consumer in an accessible manner.
